The patent marketplace has evolved over the last 10 years into a robust buy-sell environment in which many good patents are for sale and can be acquired for immediate use in cross-licensing negotiations and patent assertion campaigns. TPL has helped its clients acquire patents that have reduced their potential liabilities in patent disputes significantly, or which have resulted in millions of dollars of short term revenue. TPL specializes in the art of finding and acquiring the appropriate patent assets at market or below-market prices.
Given the vast world of patents, how is it possible to find the ones that can be acquired and fit the client’s needs? TPL specializes in patent mining, having looked at tens of thousands of patents to find a handful that can be acquired and that cover a target company’s product line.
TPL uses its highly trained technical staff, in conjunction with its proprietary iPatents software, to rate patents based on the breadth of the claims, difficulty to design around the claimed features, ease of detectability of use, and present or near-term adoption of the technology by the marketplace. These ratings allow us, in conjunction with our client, to determine which opportunities to pursue, and at what price.
TPL determines if holders of potentially valuable patents are “qualified sellers” in terms of realistic pricing expectations and a basic understanding of patent valuation and transactions. TPL weeds out companies and inventors where transactions are unlikely, so as to avoid wasting time and money pursuing patents that cannot be obtained at market prices. By focusing in on the available opportunities, TPL works with its clients to acquire the right assets at the right price.
